Changes in EU procurement: training for LPP members

LPP members are invited to attend a free training session being arranged by LPP and led by law firm Capsticks.

The final versions of a package of new public procurement directives have been agreed in Europe. Once in force (expected at the end of March 2014), the UK has set an ambitious timescale for implementation. It is therefore likely that you will need to be ready to operate under a new set of public procurement regulations by the end of 2014.

The new directives aim to overhaul the existing EU procurement regime, making it simpler and quicker for public bodies to procure goods, works and services. There are important changes being made, some offering greater flexibilities to you, which will impact on your existing procurement practices.

To help you navigate your way through this new regime, Capsticks’ procurement legal experts will be delivering a session to guide you through the main areas of reform, help you understand the impact for NHS providers, and answer your questions. The session will focus on the main areas of change which will be particularly pertinent to NHS providers, including:

• Procurement Procedures
• Express exemptions for co-operation between public entities – shared service initiatives
• Removal of the distinction between “Part A” and “Part B”
• Mandatory use of eProcurement
• Clarity over rules on material variations to existing contracts.

Capsticks will also be explaining how challenges might arise under the new regime, as well as offering tips and best practice on how to deal with any threatened or actual challenges to procurement, to give additional comfort in the early stages of transition.
